The Articles of Union

THE ARTICLES OF UNION
between
THE REPUBLIC OF TANGANYIKA AND THE PEOPLES' REPUBLIC OF ZANZIBAR
WHEREAS the Governments of the Republic of Tanganyika and of the Peoples' Republic of Zanzibar being mindful of the long association of the peoples of these lands and of their ties of kinship and amity, and being desirous of furthering that associatio! n and strengthening of these ties and of furthering the unity of African peoples have met and considered the union of the Republic of Tanganyika with the Peoples Republic of Zanzibar:
AND WHEREAS the Governments of the Republic of Tanganyika and of the Peoples'Republic of Zanzibar are desirous that the two Republics shall be united in one Sovereign Republic in accordance with the Articles hereinafter contained:-
It is therefore AGREED between the Governments of the Republic of Tanganyika and of the Peoples' Republic of Zanzibar as follows: -
(i) The Republic of Tanganyika and the Peoples' Republic of Zanzibar shall be united in one Sovereign Republic.
(ii) During the period from the commencement of the union until the Constituent Assembly provided for in Article (vii) shall have met and adopted a Constitution for the united Republic (hereinafter referred to as the interim period) the united Republic
(i! ii) to (vi).
shall be governed in accordance with the provisions of Articles
(iii) During the interim period the Constitution of the united Republic shall be the Constitution of Tanganyika so modified as to provide for-
(a) a separate legislature and executive in and for Zanzibar from time to time constituted in accordance with the existing law of Zanzibar and having exclusive authority within Zanzibar for matters other than those reserved to the Parliament and Executive of the united Republic;
(b) the offices of two Vice-Presidents one of whom (being. a person normally resident in Zanzibar) shall be the head of the aforesaid executive in and for Zanzibar and shall be the principal assistant of the President of the United Republic in the discharge of his executive functions in relation to Zanzibar;
(c) the representation of Zanzibar in the Parliament of the United Republic;
(d) such other matters! as may be expedient or desirable to give effect to the united Republic and to these Articles.
(iv) There shall reserved to the Parliament and Executive of the united Republic the following matters-
(a) The Constitution and Government of the united Republic.
(b) External Affairs.
(c) Defence.
(d) Police.
(e) Emergency Powers.
(f) Citizenship.
(g) Immigration.
(h) External Trade and Borrowing.
(i) The Public Service of the united Republic.
(j) Income Tax, Corporation Tax, Customs and Excise.
(k) Harbours, Civil Aviation, Posts and Telegraphs.
And the said Parliament and Executive shall have exclusive authority in such matters throughout and for the purposes of the united Republic and in addition exclusive authority in respect of all other matters in and for Tanganyika.
(v) The existing laws of Tanganyika and of Zanzibar shall remain in force in their respective territories subject-
(a) to any provision made hereafter by a competent legislature;
(b) to such provision as may be made by order of the President of the united Republic for the extension to Zanzibar of any law relating to any of the matters set out in Article (iv), and the revocation of any corresponding law of Zanzibar;
(c) to such amendments as may be expedient or desirable to give effect to the union and to these Articles.
(v) (a) The first President of the united Republic shall be Mwalimu Julius K. Nyerere and he shall carry on the Government of the united Republic in accordance with the provisions of these Articles and with the assistance of the Vice-Presidents aforesaid and of such other ministers and officers as he may appoint from Tanganyika and Zanzibar and their respective public services.
(b) The first Vice-President from Zanzibar to be appointed in accordance with the modifications provid! ed for in Article (iii) shall be Sheikh Abeid Karume.
(vii) The President of the united Republic: in agreement with the Vice-President who is head of the Executive in Zanzibar shall-
(a) Appoint a Commission to make proposals for a Constitution for the united Republic.
(b) Summon a Constituent Assembly composed of Representatives from Tanganyika and from Zanzibar in such numbers as they may determine to meet within one year of the commencement of the union for the purpose of considering the proposals of the Commission aforesaid and to adopt a Constitution for the united Republic.
(viii) These Articles shall be subject to the enactment of laws by the Parliament of Tanganyika and by the Revolutionary Council of the Peoples' Republic of Zanzibar in conjunction with the Cabinet of Ministers thereof, ratifying the same and providing for the Government of the united Republic and of Zanzibar in accordance therewith.
IN WITNESS WHERE Julius K. Nyerere, the President of the Republic of Tanganyika, and Abeid Karume the President of the Peoples' Republic of Zanzibar have signed these Articles, in duplicate, at Zanzibar, on this twenty-second day of April, 1964.

Mambo ya UVCCM Zanzibar

Hivi ndivyo vijana wa CCM walivyoponda raha, Nami nilishuhudia

Kiwango cha fedha ambacho mkutano wa watu 100 wa siku nne wa Umoja wa Vijana wa Chama Cha Mapinduzi (UVCCM) zilitafunwa kimegundulika, na sasa kimeacha maswali mengi juu ya matumizi makubwa kiasi hicho wakati umoja huo ukiwa hoi kimapato. Uchunguzi wa Nipashe kutoka vyanzo mbalimbali visiwani Zanzibar ulikofanyika mkutano huo vimesema kwamba kwa wastani matumzi hayo yalikuwa ni nusu bilioni ambazo zilijumuisha usafiri wa ndani, chakula na malazi katika hoteli ya kifahari ya Zamani Kempinski. Fedha hizo ambazo kwa viwango vyovyote ni nyingi kwa hali ya uchumi wa UVCCM ambayo ilisaidiwa fedha za kuendesha mkutano mkuu wa uchaguzi hivi karibuni na mfanyabishara mmoja, hakuna kiongozi yeyote wa umoja huo aliyekuwa tayari kueleza kwamba zilitoka wapi. Kwa wastani, kiasi hicho cha fedha kwa wajumbe 100 kikikokotolewa kila mjumbe atakuwa ametumia walau Shilingi milioni nne katika siku hizo sawa na Shilingi milioni moja kwa siku. Jambo ambalo linazidi kutia shaka na madai kuwa, malipo yote ya mkutano huo mkubwa uliohudhuriwa na Rais Mstaafu wa Afrika ya Kusini, Thabo Mbeki, yaliratibiwa na Januari Makamba ambaye ni msaidizi wa Rais Jakaya Kikwete anayeshughulikia hotuba na pia ni mtoto wa Katibu Mkuu wa CCM, Yusuf Makamba. Hata hivyo, Januari alipotafutwa na Nipashe hakuwa tayari kueleza nafasi yake katika mkutano huo kwani si kiongozi ndani ya UVCCM. Taarifa zilizopatikana juzi zilisema gharama za huduma za malazi ziligawanyika katika makundi manne. Kundi la kwanza la kada ya chini katika chama lilikuwa likilipiwa huduma ya malazi Sh 466,200 kwa siku, kundi la pili lilikuwa likilipiwa Sh 574,200, kundi la tatu lilikuwa likilipiwa Sh 738,00 na kundi la nne lilikuwa likilipiwa Sh milioni 1.9. Uchunguzi wa Nipashe umebaini kwamba kiasi cha Sh milioni 200 kati ya fedha zote zilizotumika zimetolewa na mfanyabiashara mmoja (jina tunalo) na nyingine zilizobaki hazijulikani zilikopatikana. Uchunguzi wa Nipashe pia umebaini kwamba pamoja na UVCCM kutumia kiasi hicho kikubwa cha fedha, bado kuna baadhi ya vyumba vililipiwa bila ya wahusika kulala kati ya vyumba 114 walivyokodi kwa sababu wengine walikuwa wanakwenda na kuondoka kutokana na majukumu mengine waliyopangiwa. Imefahamika baadhi ya wajumbe walikuwa pia wakihudhuria mkutano wa Jumuiya ya Afrika Mashariki (EAC) na Jumuiya ya Soko la Pamoja la Nchi za Mashariki na Kusini mwa Afrika (COMESA) uliofanyika Zanzibar Beach Resort iliyopo Mbweni, kiasi cha kilomita 47 kutoka hoteli ya Kempinski, mkutano wa UVCCM ulipofanyika. Wajumbe wengine walikodiwa katika hoteli ya ya Fairmont iliyopo Mkoa wa Kaskazini Unguja na kusababisha huduma za usafiri kwa wajumbe kufikia Sh milioni 6.4. Huduma za malazi zilifikia Sh milioni 216.4 kwa hoteli ya Kempinski peke yake mbali ya gharama nyingine zilizotumika kukodi hoteli ya Fairmont. Aidha, gharama za huduma za chakula kwa wajumbe zaidi ya 100 zilifikia Sh milioni 49.6.Huduma nyingine za kurudufu, uchapishaji na matumizi ya vifaa vya hoteli pia zilitumika. Viongozi wakongwe wa siasa waliohudhuria mkutano huo ni pamoja na Makamu Mwenyekiti wa CCM, (Tanzania Bara), Pius Msekwa, Kingunge Ngombare Mwiru, Mzee Hassan Nassor Moyo, Balozi Job Lusinde, Balozi Juma Mwapachu na Rais Mstaafu, Benjamin Mkapa. Hata hivyo, Mwenyekiti wa Tiafa UVCCM, Hamad Masauni Yussuf, alipopigiwa simu na Nipashe kuzungumzia mkutano huo, alitoa udhuru kwamba asingeweza kuzungumza kwa kuwa alikuwa anahudhuria kikao. Habari kutoka katika kongamano la UVCCM limeeleza kuwa wajumbe wengi waliupongeza uongozi mpya kwa kufanikisha mkutano huo, baadhi ya wajumbe walifurahi kusafirishwa kwa ndege na kuwekwa katika hoteli ya hadhi ya kimataifa. ``Kwa kweli wajumbe wengi wanaupongeza uongozi mpya wa UVCCM kwa kuwahudumia katika hadhi ya kimataifa,`` alisema mjumbe mmoja mwenye cheo cha juu katika Serikali ya Mapinduzi Zanzibar (SMZ). Alisema kitendo cha baadhi ya wajumbe kusafirishwa kwa ndege kilichukua nafasi kubwa kwa kutolewa shukrani katika kikao hicho. Mkutano huo umezua mjadala mkali baadhi ya wajumbe wakisema hakukuwa na haja ya mkutano huo kufanyika katika hoteli ya bei kubwa wakati CCM inazo kumbi kadhaa za mikutano kwa mfano ukumbi wa CCM Kisiwandui. Aidha, ilielezwa kuwa Hoteli ya Bwawani ambapo chumba ni Sh 50,000 kwa siku ingelitumika kwa mkutano huo na fedha zingebaki kusaidia mambo mengine ya kuimarisha chama. Gazeti hili lilipowasiliana na Katibu Mkuu wa UVCCM, Isack Francis, alisema hakuna haja ya kuhoji matumizi ya fedha hizo, kwa vile Nipashe haikushiriki kutoa mchango. ``Ninyi mnahoji nini, kwani fedha hizo mlichanga nyie, hili ni suala letu tuachieni wenyewe, hatujawahi kuwaomba hela yoyote, haya matumizi hayawahusu,`` alisema kwa kuhamaki. Francis alisema uamuzi wowote uliohusu kongamano hilo, ikiwemo uteuzi wa hoteli ya kitalii ya Zamani Kempinski ya visiwani Zanzibar, unaihusu UVCCM. ``UVCCM ni taasisi kubwa, ina vyanzo vingi vya fedha, hata hiyo hoteli ya kitalii tuliamua kuitumia kama wanavyoamua watu wengine, hivyo haiwahusu,`` alisema na kukata simu. Kwa upande wake, Januari Makamba, alisema ushiriki wake katika kongamano hilo, ulitokana na mwaliko ambao hata hivyo, hakusema ulitolewa na nani. Makamba aliyesisitiza kutopenda kuzungumza na vyombo vya habari, alisema akiwa katika kongamano hilo, alishiriki kumsaidia Mwenyekiti wa UVCCM, kutekeleza baadhi ya kazi za kongamano hilo. Hata hivyo, alipoulizwa kuzitaja kazi hizo, Makamba, alikataa na kusema suala hilo linapaswa kutolewa ufafanuzi na UVCCM. Naye Katibu wa Itikadi na Uenezi wa CCM, John Chiligati, alisema sakata la matumizi ya fedha hizo,linapaswa kutolewa ufafanuzi na UVCCM wenyewe. Alisema Umoja huo ni kama mtoto aliyefikia hatua ya kujitenga katika familia, hivyo kuendesha mambo yake kwa kadri alivyojipangia. ``Hawa UVCCM wanajitegemea kwa vyanzo vya fedha na hata kanuni za matumizi yake...hilo ni swali zuri, watafute wenyewe watoe ufafanuzi,`` alisema.
